Obviously the amount of time to be served is contingent on whether they are successful in the appellate stages of this case.  But in the interim, the question is whether they should be incarcerated pending their appeal.  Bernard Ebbers is free on bond and Martha Stewart could have been free but she chose to go do her time.  And in a New York State Court yesterday, Dennis Kozlowski and Mark Swartz were sent off to immediately start serving their sentence. Now the issue becomes whether the appellate tribunal will grant them bail pending their appeal. It looks like the issue is already before the appellate court.  See here.
